Codesky Terms of Service
Last Updated: December 21, 2025
Jurisdiction: Kingdom of Saudi Arabia (KSA)
1. Introduction
Welcome to Codesky, the premier Saudi-first "vibe coding" platform designed for the MENA region. These Terms of Service ("Terms") constitute a binding legal agreement between you ("User," "You") and Codesky ("Company," "We," "Us") governing your use of the Codesky platform, website, AI coding assistants, and cloud services (collectively, the "Services").
By accessing or using Codesky, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Nature of Services ("Vibe Coding")
Codesky provides an AI-powered development environment designed to facilitate "Vibe Coding"—a rapid, AI-assisted workflow for building applications.
AI Dependencies: Our Services rely on Artificial Intelligence models. You acknowledge that AI outputs can be unpredictable, may contain errors, and should be reviewed by a human before deployment in critical production environments.
Beta/Preview Features: We may release features in "Beta" which are provided "as-is" and may not be fully stable.
3. Account Registration & Security
- You must provide accurate information when creating an account.
- You are responsible for safeguarding your credentials.
- You generally must be at least 13 years old (or older depending on local MENA jurisdiction laws) to use the Services.
4. Intellectual Property & Ownership
Platform Ownership:
Codesky owns all rights, titles, and interests in the Platform, the underlying software, AI fine-tuning data created by Us, and our brand elements.
User Content:
You retain ownership of the code, assets, and applications you create ("User Content").
AI Output:
Subject to your compliance with these Terms, Codesky assigns to you all right, title, and interest in the specific output generated by the AI for your prompts.
Public vs. Private Projects:
- Public Projects: By default, projects created in the public workspace are open source. You grant other Users a license to view, fork, and remix your Public Projects (defaulting to MIT License unless specified otherwise).
- Private Projects: Available under specific subscription plans. We keep these confidential, accessed only for support, security, or legal compliance.
5. Acceptable Use Policy (KSA & Global Compliance)
You agree not to use the Services for any unlawful purpose or in violation of any applicable local or international laws. Specifically, you are prohibited from:
- Content Violations: Uploading content that violates the laws of the Kingdom of Saudi Arabia, including content that is anti-Islamic, promotes gambling, alcohol, pornography, or violates public decency/morals.
- Malicious Use: Creating malware, phishing scripts, or conducting denial-of-service attacks.
- Crypto Mining: Using Codesky cloud resources for cryptocurrency mining without explicit enterprise authorization.
- Reverse Engineering: Attempting to reverse engineer our AI models or proprietary code.
6. Payment, Credits, and Refunds
- Codesky Credits: We may use a virtual currency system ("Credits") for AI usage or cloud compute. Credits are non-transferable and have no cash value.
- Subscriptions: Paid plans are billed in advance.
- Refunds: Generally, payments are non-refundable, except where required by Saudi Consumer Protection Law.
7. Data Privacy & MENA Localization
- Data Residency: We strive to adhere to the KSA Personal Data Protection Law (PDPL).
- Usage Data: We collect anonymized usage data to improve our "Vibe Coding" models. We do not use your private code or non-public personal data to train our foundational models without your consent.
8. Disclaimers & Limitation of Liability
"As Is" Basis: The Services are provided "AS IS" without warranties of any kind. We do not guarantee that AI code is bug-free or secure.
Limitation: To the fullest extent permitted by KSA law, Codesky shall not be liable for indirect, incidental, or consequential damages, including loss of data or profits.
9. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Kingdom of Saudi Arabia.
Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts in Riyadh, Saudi Arabia.
